Fatal fall, workers' compensation death benefits possible

A fatal construction accident occurred recently in early September in Jamul. The accident involved a construction worker who fell around five stories and died as a result of his injuries. When workers die while on the job from accidents such as this one, their loved ones typically seek to file a workers' compensation death benefits claim.

According to the authorities, it occurred around 8:30 a.m. at the project site of the Hollywood Casino, near Route 94. They say that a 56-year-old man had fallen from a platform that was around 38-feet tall. Officers from the California Highway Patrol attempted CPR, but to no avail, as the man apparently died instantly as a result of the injuries suffered from his fall.

The construction site, which is located on an Indian reservation, was shut down immediately for the day, with workers being sent home. FED-OSHA responded to the incident. They are looking into what ultimately might have caused the man's fall.

The workers' compensation program in the state of California aims to provide death benefits to individuals who were related to the deceased worker -- for example, a spouse, child, parent or sibling -- and who were also financially dependent on that individual. The main purpose of the benefit is to compensate dependent family members for the loss of financial support. This compensation is also often used to help ameliorate some of the end-of-life expenses that are typically incurred by a decedent's family, including medical bills and burial costs. It is typical to consult an experienced workers' compensation attorney to assist with this process.
