A construction worker was recently killed in an out-of-state accident. The accident, which took place on an interstate highway, occurred on a Thursday afternoon in early January. When a California construction worker suffers a fatal work injury, his or her dependents may be able to file for workers’ compensation death benefits, and this worker’s family may choose to act similarly.
Two workers finishing up their work for the evening were involved in a fatal car accident, police say. The two were struck by a motorist, and one worker, a 44-year-old man, was killed in the late-afternoon crash. The crash forced the closure of all northbound lanes of the interstate for around three hours.
The second worker was flown to a local hospital, but the extent of the individual’s injuries is currently unknown. The two workers were completing additional work on a resurfacing project for the interstate at the time the accident occurred. Alcohol does not appear to have played a role in the crash, state troopers say.
Although this accident is still under investigation, the deceased worker’s loved ones may choose to file for workers’ compensation death benefits. Successfully filed, this type of claim can help dependents not only with end-of-life expenses but also to make up for the deceased worker’s future lost wages. The total amount of the benefit depends on the number of total and/or partial dependents. To assist in filing this type of claim, dependents of a California worker who was fatally wounded in a work injury typically consult an experienced workers’ compensation attorney.
